This website is operated by Vildune. Throughout the site, the terms “we”, “us” and “our” refer to Vildune. Vildune offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Vildune offers a curated selection of clothing, lounge, home, pet, and garden wares. We reserve the right to:

  • Modify or discontinue products without notice.

  • Limit quantities available for purchase on a case-by-case basis.

  • Refuse service to anyone for any legitimate business reason at any time.

  • Update pricing at any time without prior notice.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks via our Level 1 PCI-DSS compliant processing systems.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your device's screen will display any colour completely accurately.

New Zealand Consumer Law Protections

If you are buying our products for personal, domestic, or household use, your purchase is fully protected by the New Zealand Consumer Guarantees Act 1993 (CGA) and the Fair Trading Act 1986 (FTA).

  • Nothing in these terms limits, excludes, or contracts out of your rights under the CGA.

  • Our products come with non-excludable statutory guarantees that they are of acceptable quality, fit for their common purpose, and match the descriptions shown on this store.

  • If a product fails to meet these criteria, you are legally entitled to a repair, replacement, or full refund depending on whether the failure is minor or major.

Commercial Purchases: If you are acquiring our goods or services for the purposes of a business or in trade, you agree that the provisions of the Consumer Guarantees Act 1993 do not apply to our supply to you, as permitted by Section 43 of that Act.

Section 6 - Orders and Payment

  • Order Acceptance: All orders placed through our store are subject to our formal processing acceptance and raw stock availability.

  • Pricing: All prices are displayed and processed in New Zealand Dollars (NZD) and include GST where applicable under New Zealand tax laws.

  • Payment: Full payment is required at the time of checkout through our secure payment gateway (powered by Shopify).

  • Order Changes: Orders cannot be altered or modified automatically once submitted. Please contact us via email immediately if an error has occurred, and we will make every effort to accommodate changes prior to dispatch.

Section 7 - Shipping and Delivery

We ship primarily to customers located within New Zealand and Australia, with international worldwide shipping available upon request.

  • Customs, Tariffs, and Import Duties: For orders placed outside of New Zealand, you (the customer) are considered the importer of record. You are strictly responsible for checking, managing, and paying any local import duties, customs tariffs, clearing fees, or regional taxes levied by your home country's border authorities upon arrival. Vildune has no control over these regional fees.

  • Risk of Loss: Delivery timeframes are logical estimates provided by our couriers and are not absolute guarantees. Risk of loss passes to you upon delivery of the items to the designated carrier infrastructure.

Section 8 - Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made.

We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. When creating an account, you must provide accurate information, keep your login credentials private and secure, and accept full responsibility for all activities occurring under your account profile.

Section 9 - Optional Third-Party Tools

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input (such as third-party payment options or analytical widgets).

Subject to Section 5 and your mandatory, non-excludable statutory protections under the New Zealand Consumer Guarantees Act 1993:

  • The service and all products delivered to you through the service are provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties of merchantability, quality, fitness for a particular purpose, and durability.

In no case shall Vildune, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such jurisdictions, our liability shall be limited to the maximum extent permitted by local regional law.

You agree to indemnify, defend, and hold harmless Vildune and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms of Service or your violation of any law or the rights of a third party.

Section 18 - Severability

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

These Terms of Service are effective unless and until terminated by either you or us.
